Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Brandwavr(“Brandwavr”, “we”, “us”), a service that generates marketing content — including brand analysis, strategy, copy, and videos — from the inputs you provide. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to use Brandwavr.

2. Credits and payments

  • Brandwavr runs on credits. Generating one video consumes one credit.
  • Credits are obtained two ways, through our payment processor, Stripe: one-time packs, and monthly subscription plans. We do not store your full card details.
  • Credits are for use within the service, have no cash value, and are non-transferable.
  • Credits from one-time packs do not expire. They remain in your balance until you spend them.
  • Credits included in a monthly plan expire at the end of each billing period. Each period begins with a fresh allotment; unused credits from the previous period do not carry over and are not refunded. Plan credits are spent before any pack credits you hold.
  • Subscriptions renew automatically. If you choose a monthly plan, your payment method is charged the then-current price every month on the same date until you cancel. We will email a receipt for each charge.
  • You may cancel at any time from the Credits page in your account, which opens our payment processor's billing portal. Cancellation takes effect at the end of the billing period you have already paid for: your plan credits stay usable until that date and then expire, and you are not charged again. Except where required by law, we do not provide partial refunds for a period already begun.
  • If a scheduled payment fails, your plan may be suspended and no new credits are granted. Credits already in your balance are unaffected.
  • Except where required by law, credits are non-refundable once a generation has consumed them. If a generation fails due to our error, the credit is returned to your balance automatically.
  • Prices, pack contents, and plan allotments may change. Changes apply to future purchases, and for subscriptions take effect no earlier than your next renewal after we notify you.

3. Your content and license

You retain ownership of the inputs you submit (URLs, descriptions, images, text) and, as between you and us, of the outputs generated for you. You grant us a limited license to process, store, and transmit your inputs and outputs solely to operate and improve the service (for example, to generate, render, store, and let you download your videos). You are responsible for ensuring you have the rights to any material you upload.

4. AI-generated content

Outputs are produced by automated AI systems and may be inaccurate, generic, or similar to content generated for others. You are responsible for reviewing outputs before use and for ensuring they are lawful, non-infringing, and appropriate for your purpose. Brandwavrmakes no warranty that outputs are original, accurate, or fit for any particular use.

5. Acceptable use

You agree not to use Brandwavr to:

  • infringe intellectual property, privacy, or publicity rights;
  • create unlawful, deceptive, harassing, hateful, or explicit content;
  • impersonate any person or organization, or misrepresent affiliation;
  • attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; or
  • resell or abuse the service in a way that harms Brandwavr or others.

We may suspend or terminate accounts that violate these Terms.

6. Third-party services

Brandwavr relies on third parties to function, including cloud hosting and storage, payment processing (Stripe), analytics, and AI model providers. Your use of the service is also subject to those providers’ terms where applicable. See our Privacy Policy for how data is shared with them.

7. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, Brandwavr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the three months before the claim, or USD 50.

9. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination will survive.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
